Father Pavone urges followers to cast their votes against judicial activism

TITUSVILLE, FL -- The U.S. Supreme Court’s 1973 Roe v. Wade and Doe v. Bolton decisions that legalized abortion throughout pregnancy was the “most egregious” example of judicial activism, according to Father Frank Pavone, National Director of Priests for Life, but it was far from the only time that federal judges have reinterpreted the Constitution or rewritten laws.

On his daily Pro-Life #MAGA class broadcast on Facebook Live and EndAbortion.TV, Father Pavone pointed out that when the American colonists wanted to be break free of British rule, they presented a list of 27 reasons – and four of them concerned the behavior of judges.

“Judicial activism was a key reason for the Revolution in the first place,” he said.

During his talk titled “Make the Courts Great Again,” Father Pavone explained some other startling examples in which a single federal judge “with the stroke of a pen” invalidated public referenda or reinterpreted laws. Among the cases cited were:

  • California Proposition 187, a 1994 ballot initiative passed by voters to stem the flow of illegal aliens into the state that was declared unconstitutional by a single federal judge.
  • Missouri vs. Jenkins, in which a single federal judge ordered an increase in local property taxes in Kansas City, MO, in 1991-92.

Father Pavone also cited Engle vs. Vitale, a 1962 U.S. Supreme Court case in which six justices, relying on no judicial precedents, struck down prayer in public schools.

His remarks on judicial activism were part of Priests for Life’s voter education training series that stresses the many reasons that pro-life voters must vote against the pro-abortion Democrat Party in this midterm election.

A pro-life president like President Trump has the opportunity to nominate scores of federal judges – and has done so already, notably Supreme Court Justices Neil Gorsuch and Brett Kavanaugh. But if the Democrats regain control of the Senate, Father Pavone explained, Trump’s future nominees will be blocked. Despite the Democrats’ obstructionism in the Senate even now, the President has managed to get 84 judges confirmed on the federal courts, doing better than any past president at this time in his term. But there is a lot more work to do, with some 154 vacancies (current or imminent) to fill.

 “In the 2016 election, the makeup of the federal courts was a motivating factor for 51 percent of the voters,” he said, “and most of them voted for Donald Trump. We need to get those voters out again.”
