H.R. 4712 & S. 220 - Born-Alive Abortion Survivors Protection Act

The Born-Alive Abortion Survivors Protection Act would set penalties for any health care practitioner who is present at the time a child is born alive after an abortion or attempted abortion and who fails to provide the same level of care to that child that would be given to any other baby born alive.

The House version of the bill, H.R. 4712, and the Senate version, S.220, would amend a section of the federal criminal code which requires babies who survive abortions to be given medical care. Currently, there are no penalties for those who violate that law. The bill would also allow a mother whose child survived an abortion, but who did not receive proper care, to file a lawsuit in civil court against the abortionist who failed to help her child.

An identical version of H.R. 4712 was previously introduced in this Congress as H.R. 37 by now-retired Congressman Trent Franks.
The Born-Alive Abortion Survivors Protection Act was introduced in the previous Congress as H.R. 3504. That bill was passed by the House in September 2015, but did not receive a vote in the Senate.
