H.R. 644 & S. 301 – Conscience Protection Act of 2017

The Conscience Protection Act of 2017 would amend the Public Health Service Act to prohibit the federal government or state and local governments that receive federal assistance from discriminating against a health care provider that refuses to be involved in or provide coverage for abortions. Health care providers would include health care professionals, health care facilities, social services providers, health care professional training programs, and health insurers.
The bill would require the Office for Civil Rights of the Health and Human Services Department to investigate any complaint of discrimination based on an individual’s religious or moral belief, or refusal to be involved in an abortion. An aggrieved health care provider would be able to file a civil action against the discriminating government regardless of whether that provider has sought or obtained an administrative remedy.
