Fr. Pavone calls D.C. court ruling on HHS mandate 'most positive yet’

STATEN ISLAND, NY – Father Frank Pavone, National Director of Priests for Life, issued the following statement today regarding another positive development in the ongoing legal battle against the HHS mandate.


On Dec. 18, the D.C. District Court ruled that the Obama administration must suggest another alternative to the contraception and abortifacient mandate for two plaintiffs – a Catholic college and a Christian college -- and the court said it will check in with the administration every 60 days to see what progress has been made.


“We are pleased that the court is willing to take this stance with the Obama administration,” Father Pavone said. “At the same time, we don’t expect any cooperation from Obama’s team, because they simply oppose religious freedom.”


Priests for Life filed suit against the HHS mandate in February, and has been in open violation of the ruling since Aug. 1. Those covering the various lawsuits and those who are just interested in protecting the U.S. Constitution are invited to visit priestsforlife.org/hhsmandate. “Every American has a stake in this situation,” Father Pavone said. “It’s important that all of us keep a close eye on what the administration does in regard to this unjust mandate.  The only acceptable outcome to us is the total reversal of the HHS mandate, and we will continue pressing for that through our lawsuit.”

The HHS mandate I know as a matter of law how to prove precisely and accurately in "federal" court as a matter of law is a violation under the Free Exercise of Religion Clause to the Federal First Amendment. As a proposed Plaintiff for Priests For Life or all Prolife organizations, I dare say, that I have been aggrieved since 1980 when terminated from my federal employment at Camp Pendleton, CA and have been unemployed since then (32+ years) working exclusively on this particular issue turning from civil engineer into a legal researcher for the Right to Life Movement yet on my own agenda which I began in 1979 opposing including abortion, contraception and sterilization coverage in the Federal Employees Group Health Insurance Premium Benefits [“FHB”] plans offered to an incoming federal employee which I was. The only difference is that today all under the HHS mandate are now required to join a similar FHB plan. See Rosano v. U.S., 9 Cl.Ct. 137 (1985) etc. if you don't believe me! Currently pending inside a justification defense argument since March 1, 2012, pending for my oral argument Pro Se in the “New York State” Appellate Term in Brooklyn, New York appealing a criminal conviction, I am raising this issue which is synonymous to the HHS mandate only that I have the favorable burden of proof on the government not the other way around, i.e., to disprove all my arguments beyond a reasonable doubt. Upon request I’ll send you my latest letter I just sent to a law professor responding to all his objections to prove how abortion and contraception will become unconstitutional as well as the HHS mandate.
