Fr. Frank Pavone of Priests for Life – Appeals Court Appears to Call for Precepts of Roe v. Wade to Be Struck Down

Staten Island, NY – Fr. Frank Pavone, National Director of the Catholic Church’s largest pro-life organization, Priests for Life, today said that the federal appeals court ruling against North Dakota’s “heartbeat law” is “a Pyrrhic victory for abortionists” that contains many encouraging words for pro-lifers.
“When a federal appeals court spends a great deal of its opinion finding fault with the Supreme Court’s abortion decisions, that bodes well for the future of mothers, fathers, and their babies,” said Fr. Pavone.  “With their ruling on the North Dakota law, the Eighth Circuit Court of Appeals judges basically said that they thought states should have the right to make their own abortion laws, but that Supreme Court precedents don’t allow lower courts to make such a holding.  In so many words, the judges appear to be calling for the Supreme Court to revisit, if not overturn Roe v. Wade.”
A three-judge panel of the Eighth Circuit Court of Appeals affirmed a lower court’s ruling that struck down North Dakota’s law that protected from abortion a baby with a detectable heartbeat.  While finding that the law was unconstitutional because it prohibited abortion before a baby is viable, that is, able to live outside the womb, the Court was critical of the viability standard itself.
“It’s notable that the federal appeals court cited factual changes about abortion that have occurred since the Roe decision,” added Fr. Pavone.  “It mentioned not only the medical and scientific advances that allow premature babies to survive birth at younger and younger ages, but also the harm that abortion does to women, the coercion to abort that negates any pretense of ‘choice,’ and the fact that both of the plaintiffs in Roe v. Wade and Doe v. Bolton ‘later advocated against those very decisions.’”
