TITUSVILLE, FL -- On behalf of Priests for Life, the American Freedom Law Center this week filed an amicus curiae brief in the U.S. Supreme Court case Food and Drug Administration vs. Alliance for Hippocratic Medicine.

The Court will hear oral arguments March 26 in the case that could significantly impact the way the abortion drug mifepristone is distributed and how long into pregnancy it may be prescribed.

The U.S. Court of Appeals for the Fifth Circuit ruled in August 2023 that changes the FDA made in 2016 and 2021 to expand the use of mifepristone from seven to 10 weeks of pregnancy and to allow it to be prescribed via telemedicine and sent through the mail were arbitrary and capricious and that the agency “failed to address several important concerns about whether the drug would be safe for the women who use it.”

In the brief, Priests for Life summarized the testimonies of women from the Silent No More Awareness Campaign who were harmed by their experience with chemical abortion, and pointed out that the FDA removed restrictions that would “at a minimum, help to mitigate some of the harmful effects of what can only be described as a diabolical procedure as its objective is to destroy innocent human life.”

Priests for Life concurs with the Fifth Circuit ruling and has asked the Supreme Court to affirm it.

“Our friend of the court brief brings to these proceedings the same voices which year after year are expressed right outside the Court when those who have been wounded by abortion publicly share their testimonies,” said Priests for Life National Director Frank Pavone. “The brief will illustrate from the powerful personal experience how the reckless behavior of the FDA has put countless women in danger.”

Executive Director Janet Morana, who co-founded Silent No More, said she is hopeful that the justices will carefully consider the voices of experience contained in the brief.

“For too long the government has been saying, and the abortion-friendly media has been amplifying, that chemical abortion is easy and safe,” she said. “Nothing could be further from the truth, as these testimonies prove.”
