South Carolina case to be heard by Supreme Court could have major impact on abortion cartels

TITUSVILLE, FL - Priests for Life National Director Frank Pavone issued the following statement today after learning the U.S. Supreme Court would hear a case on the right of states to withhold Medicaid funds from Planned Parenthood.

“This is great news for the state of South Carolina, which brought the suit, and for every state that cares about its people,” Pavone said. “We will be following this case closely. It will have major ramifications for the nation’s largest abortion business.”

The case, Kerr v. Planned Parenthood, will be heard next spring.

Under federal law, Medicaid funds cannot be used to pay for abortion but Planned Parenthood receives reimbursement for other services it provides. In 2018, South Carolina Gov. Henry McMaster cut off all Medicaid funding to abortion businesses in the state. A federal district court and an appeals court later ruled against McMaster’s plan. Alliance Defending Freedom, the law firm representing the state, asked the Supreme Court to review that case. That request was granted today.

“I feel confident about the case,” Pavone continued, “because the Court’s current approach to abortion is to give deference to the states and the policies they enact regarding abortion. There is no constitutional requirement to either support or fund abortion.”
