H.R. 36 - Pain-Capable Unborn Child Protection Act

H.R. 36, the Pain Capable Unborn Child Protection Act, would protect from abortion unborn babies 20 weeks of age or older, except where a pregnancy poses a physical threat to the mother’s life or is the result of rape. In the last Congress, the bill was also numbered H.R. 36.

In addition to establishing protection for late-term unborn children, the measure establishes civil remedies and criminal penalties for violations of the Born-Alive Infants Protection Act of 2002. That law requires abortionists to provide appropriate medical care to babies who survive abortions, but currently has no penalty provision for those who violate it.

H.R. 36 would set penalties for an abortionist who performs a post-20-week abortion when the pregnancy is the result of rape or poses a physical threat to the mother’s life, yet does not provide proper care to the baby who survives the abortion.

The Pain-Capable Unborn Child Protection Act, which is sponsored by Representative Trent Franks (AZ-8), is based on scientific research showing that unborn babies are capable of feeling pain no later than 20 weeks of development.

Prior versions of the Pain-Capable Unborn Child Protection Act were adopted by the House of Representatives in 2014 and 2015, but never received a floor vote in the Senate.
